アフリカ諸国に対する食糧増産援助に関する日本国政府と国際連合食糧農業機関との間の交換公文

Rome, February 17, 1989
書簡をもって啓上いたします。本使は、移動性バッタにより罹災したアフリカ諸国に対する国際連合食糧農業機関(以下「機関」という。)の食糧生産緊急援助計画(以下「計画」という。)に関して日本国政府(以下「政府」という。)の代表者と機関の代表者との間で最近行われた討議に言及するとともに、次の取極を政府に代わって提案する光栄を有します。
Sir, I have the honour to refer to the recent discussions held between the representatives of the Government of Japan (hereinafter referred to as "the Government") and the Food and Agriculture Organization of the United Nations (hereinafter referred to as "the Organization") in relation to the latter's emergency aid programme of food production for African countries suffering from migratory locusts and grasshoppers (hereinafter referred to as "the Programme") and to propose on behalf of the Government the following arrangements:
1 政府は、計画を実施することに寄与するため、日本国の関係法令に従い、機関に対して十億円(一、〇〇〇、〇〇〇、〇〇〇円)を限度とする額の贈与(以下「贈与」という。)を行う。
1. For the purpose of contributing to the execution of the Programme, the Government will extend to the Organization in accordance with the relevant laws and regulations of Japan, a grant up to one billion yen (1,000,000,000) (hereinafter referred to as "the Grant").
2 政府は、1にいう額を、機関によって指定される日本国の外国為替公認銀行東京店に開設される機関の名義の勘定に日本円で払い込むことにより、贈与を実施する。払込みは、政府の関係当局と機関との間の合意によって延長されない限り、この取極が効力を生ずる日から千九百八十九年三月三十一日までの期間中に行われる。
2. The Government will execute the Grant by making a payment in Japanese yen of the amount referred to in paragraph 1 above to an account to be opened in the name of the Organization in the Tokyo office of an authorized foreign exchange bank of Japan designated by the Organization. The payment will be made during the period between the date of coming into force of the present arrangements and March 31, 1989, unless the period is extended by mutual agreement between the authority concerned of the Government and the Organization.
3(1) 贈与は、機関によりバッタ駆除に必要な殺虫剤及び噴霧用車両の購入並びにこの購入に関連する輸送費、保険料及び機関の手数料に使用される。
3.(1) The Grant will be used by the Organization for the purchase of pesticides and spraying vehicles necessary for the extermination of locusts and grasshoppers, and for the expenses for transportation, insurance and the Organization's agency fees related with such purchase.
(2) 贈与は、(1)にいう生産物及び役務を調達適格国(その範囲は、政府の関係当局と機関の間で合意される。)において購入するために使用することができる。
(2) The Grant may be used for the purchase of the products and services of the kind mentioned in sub-paragraph (1) above in eligible source countries, the scope of which will be agreed upon between the authority concerned of the Government and the Organization.
(3) 機関は、計画の実施のために必要なすべての経費((1)に掲げるものを除く。)についての財政的措置に関し、全般的な責任を負う。
(3) The Organization will bear overall responsibility for financial arrangement for all the expenses, other than those listed in sub-paragraph (1) above, necessary for the execution of the Programme.
4 機関は、贈与に基づいて購入した生産物をできる限り速やかに罹災アフリカ諸国(その範囲は、贈与の割当てとともに、政府の関係当局と機関との間で合意される。)の政府に引き渡すために必要なすべての措置をとる。
4. The Organization will take all the necessary measures to deliver the products purchased under the Grant to the Governments of the suffering African countries as soon as possible, the scope of which as well as the allocation of the Grant will be agreed upon between the authority concerned of the Government and the Organization.
5 政府及び機関は、この取極から又はこれに関連して生ずるいかなる問題についても相互に協議する。
5. The Government and the Organization will consult with each other with respect to any matter that may arise from or in connection with the present arrangements.
6 機関は、この取極の実施の進捗状況(2にいう勘定からの出金に関するものを含む。)につき、政府に通報する。
6. The Organization will inform the Government of the progress of the implementation of the present arrangements including funds withdrawn form the account referred to in paragraph 2 above.
本使は、更に、この書簡及び機関に代わって前記の取極を確認される貴官の返簡が政府と機関との間の合意を構成するものとみなし、その合意が貴官の返簡の日付の日に効力を生ずることを提案する光栄を有します。
I have further the honour to propose that this Note and your Note in reply confirming on behalf of the Organization the foregoing arrangements shall be regarded as constituting an agreement between the Government and the Organization, which will enter into force on the date of your reply.

Excellency, I have the honour to acknowledge the receipt of Your Excellency's Note of today's date which reads as follows:

本官は、更に、国際連合食糧農業機関に代わって前記の取極を確認するとともに、閣下の書簡及びこの返簡が日本国政府と機関との間の合意を構成するものとみなし、その合意がこの返簡の日付の日に効力を生ずることに同意する光栄を有します。
I have further the honour to confirm the foregoing arrangements on behalf of the Food and Agriculture Organization of the United Nations and to agree that Your Excellency's Note and this Note shall be regarded as constituting an agreement between the Government of Japan and the Organization, which will enter into force on the date of this reply.
