青年海外協力隊の派遣に関する日本国政府とイエメン・アラブ共和国政府との間の交換公文

Sana'a, September 9, 1989
書簡をもって啓上いたします。本使は、日本国とイエメン・アラブ共和国との間の技術協力を促進するため青年海外協力隊計画(以下「計画」という。)に基づき協力隊員をイエメン・アラブ共和国に派遣することに関し、日本国政府の代表者とイエメン・アラブ共和国政府の代表者との間でサナにおいて行われた最近の討議に言及するとともに、これらの代表者の間で到達した次の了解を日本国政府に代わって確認する光栄を有します。
Excellency,I have the honour to refer to the recent discussions held in Sana's between the representatives of the Government of Japan and of the Government of the Yemen Arab Republic concerning the dispatch of volunteers to the Yemen Arab Republic under the Japan Overseas Cooperation Volunteers Programme (hereinafter referred to as "the Programme") with a view to promoting technical cooperation between the two countries, and to confirm on behalf of the Government of Japan the following understanding reached between them:
1 日本国政府は、イエメン・アラブ共和国政府の要請に基づき、日本国の現行法令に従い、イエメン・アラブ共和国の社会的及び経済的開発に寄与するため、両政府の関係機関間で別個に合意される計画に従い協力隊員をイエメン・アラブ共和国に派遣するために必要な措置をとる。
1. At the request of the Government of the Yemen Arab Republic, the Government of Japan will, in accordance with the laws and regulations in force in Japan, take necessary measures to dispatch the volunteers to the Yemen Arab Republic for the purpose of contributing to the social and economic development of the Yemen Arab Republic, according to the schedules to be separately agreed upon between the authorities concerned of the two Governments.
2 日本国政府は、予算措置がとられることを条件として、協力隊員の日本国とイエメン・アラブ共和国との間の渡航費及びイエメン・アラブ共和国における生活手当を負担し、また、協力隊員の任務の遂行に必要な装備、機械、材料及び医薬品を供与するために必要な措置をとる。
2. The Government of Japan will, subject to budgetary appropriations, take necessary measures to bear the cost of international travel between Japan and the Yemen Arab Republic and living allowances in the Yemen Arab Republic for the volunteers and to make available such equipment, machinery, materials and medical supplies as may be necessary for the performance of their functions.
3 イエメン・アラブ共和国政府は、協力隊員に対し、次の特権、免除及び便宣を与える。
3. The Government of the Yemen Arab Republic will grant the volunteers the following privileges, exemptions and benefits:
(1) 2にいう装備、機械、材料及び医薬品の輸入に関して、関税、租税その他の課徴金の免除
(1) Exemption from customs duties, taxes and charges of any kind in respect of the importation of the equipment, machinery, materials and medical supplies mentioned in paragraph 2 above.
(2) 身回品及び家財の輸入であって、協力隊員が任務を遂行する場所に到着してから六箇月以内に行われるものに関して、関税、租税その他の課徴金の免除。当該物品が、その後イエメン・アラブ共和国において、関税、租税若しくは課徴金の免除又は同様の特権を与えられていない個人又は団体に売却又は譲渡される場合には、関税、租税又は課徴金の支払に従うことを条件とする。
(2) Exemption from customs duties, taxes and charges of any kind in respect of the importation of their personal and household effects, being imported within six months from their arrival at places where they are to perform their function. The said effects will be subject to payment of customs duties, taxes and charges if they are subsequently sold or transferred within the Yemen Arab Republic to individuals or organizations not entitled to exemption from such duties, taxes and charges or similar privileges.
(3) 2にいう生活手当等協力隊員に対して海外から送付される手当に関して、所得税その他の課徴金の免除
(3) Exemption from income taxes and charges of any kind in respect of any allowances to be remitted for them from overseas such as the living allowances mentioned in paragraph 2 above.
(4) 協力隊員のイエメン・アラブ共和国における任期中の無料診療
(4) Free medical care during the term of their assignment in the Yemen Arab Republic.
(5) 協力隊員がイエメン・アラブ共和国政府より与えられる任務を遂行する場所における無料の住居施設の提供又は住居費に充当するための月額千イエメン・リアルの現地通貨による支給
(5) Rent-free housing accommodations with basic furnishings, or the amount of YR1,000 per month in local currency to meet the accommodation cost, at places where they are to perform their functions to be assigned to them by the Government of the Yemen Arab Republic.
4(1) イエメン・アラブ共和国政府は、イエメン・アラブ共和国における計画の活動に関連して日本国政府による技術及び経済協力の実施機関である国際協力事業団が与える任務を遂行する駐在員一名及び調整員を受け入れる。
4.(1) The Government of the Yemen Arab Republic will accept a Representative and Coordinators who will discharge the functions to be assigned to them by the Japan International Cooperation Agency, the executing agency for technical and economic cooperation by the Government of Japan, relative to the activities of the Programme in the Yemen Arab Republic.
(2) イエメン・アラブ共和国政府は、駐在員及び調整員に対し、次の特権、免除及び便宣を与える。
(2) The Government of the Yemen Arab Republic will grant the Representative and the Coordinators the following privileges, exemptions and benefits:
(i) 駐在員及び調整員の任務の遂行に必要な装備、機械、材料及び医薬品の輸入に関して、関税、租税その他の課徴金の免除
(i) Exemption from customs duties, taxes and charges of any kind in respect of the importation of the equipment, machinery, materials and medical supplies, necessary for the performance of their functions.
(ii) 身回品及び家財の輸入であって、駐在員及び調整員が任務を遂行する場所に到着してから六箇月以内に行われるものに関して、関税、租税その他の課徴金の免除。当該物品が、その後イエメン・アラブ共和国において、関税、租税若しくは課徴金の免除又は同様の特権を与えられていない個人又は団体に売却又は譲渡される場合には、関税、租税又は課徴金の支払に従うことを条件とする。
(ii) Exemption from customs duties, taxes and charges of any kind in respect of the importation of their personal and household effects, being imported within six months from their arrival at places where they are to perform their functions. The said effects will be subject to payment of customs duties, taxes and charges if they are subsequently sold or transferred within the Yemen Arab Republic to individuals or organizations not entitled to exemption from such duties, taxes and charges or similar privileges.
(iii) 駐在員及び調整員に対して海外から送付される報酬又は手当に関して、所得税その他の課徴金の免除
(iii) Exemption from income taxes and charges of any kind in respect of any emoluments or allowances to be remitted for them from overseas.
(iv) 駐在員及び調整員各一名につき一台の自動車の、駐在員及び調整員が任務を遂行する場所に到着してから六箇月以内の無税輸入又はイエメン・アラブ共和国における保税倉庫からの購入。当該自動者が、その後イエメン・アラブ共和国において、関税、租税若しくは課徴金の免除又は同様の特権を与えられていない個人又は団体に売却又は譲渡される場合には、関税、租税又は課徴金の支払に従うことを条件とする。
(iv) Importation free of duties (or purchase from bond in the Yemen Arab Republic) of one motorcar for each of the Representative and the Coordinators, being imported within six months from their arrival at places where they are to perform their functions. The said motorcar will be subject to payment of customs duties, taxes and charges if they are subsequently sold or transferred within the Yemen Arab Republic to individuals or organizations not entitled to exemption from such duties, taxes and charges of similar privileges.
5 イエメン・アラブ共和国政府は、請求が、イエメン・アラブ共和国における協力隊員の公務に起因して生じ、その遂行の過程で生じ、又はその遂行中における作為若しくは不作為に関連して生じた場合には、その請求に関する責任を負う。ただし、それらの請求が協力隊員の重大な過失又は故意から生じた場合には、この限りでない。
5. The Government of the Yemen Arab Republic will bear claims, if any arises, resulting from, occurring in the course of, or otherwise connected with any action performed or omission made in the course of the official functions by the volunteers in the Yemen Arab Republic except when such claims arise from gross negligence or willful misconduct on the part of the volunteers.
6 駐在員、調整員及び協力隊員は、イエメン・アラブ共和国の法令を尊重する。
6. The Representative, Coordinators and volunteers shall respect the laws and regulations of the Yemen Arab Republic.
7 イエメン・アラブ共和国政府は、同国において同様の任務を遂行する第三国の者がこの了解に定める待遇より有利な待遇を与えられる場合には、当該第三国の者に与えられる待遇より不利でない待遇を、駐在員、調整員又は協力隊員に直ちに与える。
7. In cases where treatment more favourable than that provided for herein is accorded to persons of any third country performing similar functions in the Yemen Arab Republic, the Government of the Yemen Arab Republic will forthwith accord to the Representative, Coordinators or volunteers treatment no less favourable than that accorded to the persons of such third country.
8 両政府は、イエメン・アラブ共和国における計画の実施の成功及び必要な調整のため随時協議する。当該調整を行うため、イエメン・アラブ共和国側の指定された当局である中央企画庁は、必要な措置をとる。
8. The two Governments will hold consultations from time to time, for the successful implementation of and necessary coordination for the Programme in the Yemen Arab Republic. To ensure the said coordination, necessary measures will be taken by the C.P.O., the designated authorities on the side of the Yemen Arab Republic.
9 この了解は、両政府間の書簡の交換によって修正することができ、かつ、いずれかの政府が他方の政府に対しこの了解を終了させる意思を六箇月前に書面によって通告することにより終了させることができる。
9. The understanding set out above may be amended by an exchange of notes between the two Governments and terminated by either Government by giving to the other six months' written notice of its intention to terminate it.
本使は、更に、この書簡及び前記の了解をイエメン・アラブ共和国政府に代わって確認される閣下の返簡が両政府間の合意を構成するものとみなし、その合意が閣下の返簡の日付の日に効力を生ずるものとすることを提案する光栄を有します。
I have further the honour to propose that this Note and Your Excellency's Note in reply confirming on behalf of the Government of the Yemen Arab Republic the foregoing understanding shall be regarded as constituting an agreement between the two Governments, which will enter into force on the date of Your Excellency's reply.

本大臣は、更に、前記の了解をイエメン・アラブ共和国政府に代わって確認するとともに、閣下の書簡及びこの返簡が両政府間の合意を構成するものとみなし、その合意がこの返簡の日付の日に効力を生ずるものとすることに同意する光栄を有します。
I have further the honour to confirm on behalf of the Government of the Yemen Arab Republic the foregoing understanding and to agree that Your Excellency's Note and this Note shall be regarded as constituting an agreement between the two Governments, which will enter into force on the date of this reply.
