円借款の供与に関する日本国政府とトルコ共和国政府との間の交換公文

Ankara, December 21, 1989
書簡をもって啓上いたします。本使は、日本国とトルコ共和国との間の友好関係及び経済協力を強化することを目的として資金還流措置の下で供与される日本国の借款に関して日本国政府の代表者とトルコ共和国政府の代表者との間で最近到達した次の了解を確認する光栄を有します。
Excellency,I have the honour to confirm the following understanding recently reached between the representatives of the Government of Japan and of the Government of the Republic of Turkey concerning a Japanese loan to be extended under the Financial Recycling Scheme with a view to strengthening the friendly relations and economic cooperation between the two countries:
1 三百五十二億円(三五、二〇〇、〇〇〇、〇〇〇円)の額までの円貨による借款(以下「借款」という。)が、第三次農業信用計画(以下「計画」という。)を実施するため、海外経済協力基金(以下「基金」という。)により、日本国の関係法令に従って、トルコ共和国政府に供与されることになる。
1. A loan in Japanese yen up to the amount of thirty-five billion two hundred million yen (35,200,000,000) (hereinafter referred to as "the Loan") will be extended to the Government of the Republic of Turkey by the Overseas Economic Cooperation Fund (hereinafter referred to as "the Fund") in accordance with the relevant laws and regulations of Japan, for the implementation of the Third Agricultural Credit Project (hereinafter referred to as "the Project").
2(1) 借款は、トルコ共和国政府と基金との間で締結される借款契約に基づいて使用に供される。借款の条件及び使用に関する手続は、なかんずく次の原則を含むことになる前記の借款契約によって規制される。
2.(1) The Loan will be made available by a loan agreement to be concluded between the Government of the Republic of Turkey and the Fund. The terms and conditions of the Loan as well as the procedures for its utilization will be governed by the said loan agreement which will contain, inter alia, the following principles:
(a) 償還期間は、七年の据置期間の後十八年とする。
(a) The repayment period will be eighteen (18) years after the grace period of seven (7) years.
(b) 利子率は、年二・九パーセントとする。
(b) The rate of interest will be two and nine tenths (2.9) per cent per annum.
(c) 支出期間は、借款契約の発効の日から五年とする。
(c) The disbursement period will be five (5) years from the date of coming into force of the said loan agreement.
(2) (1)にいう借款契約は、基金が計画の実行可能性を確認した後に締結される。
(2) The loan agreement mentioned in sub-paragraph (1) above will be concluded after the Fund is satisfied of the feasibility of the Project.
(3) (1)(c)にいう支出期間は、両政府の関係当局の同意を得て延長することができる。
(3) The disbursement period mentioned in sub-paragraph (1) (c) above may be extended with the consent of the authorities concerned of the two Governments.
3 借款は、農業生産の振興のために借入人に対しトルコ農業銀行により既に供与されたか又は供与される融資に充てるために使用に供される。
3. The Loan will be made available to cover credits already extended or to be extended by the Agricultural Bank of Turkey to the sub-borrowers for the development of agricultural production.
4 トルコ共和国政府は、基金について、借款及びそれから生ずる利子に対して又はそれらに関連してトルコ共和国において課されるすべての財政課徴金又は租税を免除する。
4. The Government of the Republic of Turkey will exempt the Fund from all fiscal levies or taxes imposed in the Republic of Turkey on and/or in connection with the Loan and interest accruing therefrom.
5 トルコ共和国政府は、借款が適正にかつ専ら計画のために使用されることを確保するために必要な措置をとる。
5. The Government of the Republic of Turkey will take necessary measures to ensure that the Loan be used properly and exclusively for the Project.
6 トルコ共和国政府は、要請に応じ、日本国政府及び基金に対し、計画の実施の進捗状況に関する情報及び資料を提供する。
6. The Government of the Republic of Turkey will, upon request, furnish the Government of Japan and the Fund with in formation and data concerning the progress of the implementation of the Project.
7 両政府は、前記の了解から又はそれに関連して生ずることのあるいかなる事項についても相互に協議する。
7. The two Governments will consult with each other in respect of any matter that may arise from or in connection with the foregoing understanding.
本使は、閣下が前記の了解をトルコ共和国政府に代わって確認されれば幸いであります。
I should be grateful if Your Excellency would confirm the foregoing understanding on behalf of the Government of the Republic of Turkey.
本使は、以上を申し進めるに際し、ここに閣下に向かって敬意を表します。
