円借款の供与に関する日本国政府とパキスタン回教共和国政府との間の交換公文

書簡をもって啓上いたします。本使は、パキスタン回教共和国の洪水災害救済及び経済再建に寄与することを目的とし、資金還流措置の下で供与される日本国の借款に関して日本国政府の代表者とパキスタン回教共和国政府の代表者との間で最近到達した次の了解を確認する光栄を有します。
Excellency, I have the honour to confirm the following understanding recently reached between the representatives of the Government of Japan and of the Government of the Islamic Republic of Pakistan concerning a Japanese loan to be extended under the Financial Recycling Scheme with a view to contributing to the flood disaster relief and economic reconstruction of the Islamic Republic of Pakistan:
1 百五億円(一〇、五〇〇、〇〇〇、〇〇〇円)の額までの円貨による商品借款(以下「商品借款」という。)が、海外経済協力基金(以下「基金」という。)により、日本国の関係法令に従って、パキスタン回教共和国政府に供与されることになる。
1. A commodity loan in Japanese yen up to the amount of ten billion five hundred million yen (10,500,000,000) (hereinafter referred to as "the Commodity Loan") will be extended to the Government of the Islamic Republic of Pakistan by the Overseas Economic Cooperation Fund (hereinafter referred to as "the Fund") in accordance with the relevant laws and regulations of Japan.
2(1) 商品借款は、パキスタン回教共和国政府と基金との間で締結される借款契約に基づいて使用に供される。商品借款の条件及び使用に関する手続は、なかんずく次の原則を含むことになる前記の借款契約によって規制される。
2.(1) The Commodity Loan will be made available by a loan agreement to be concluded between the Government of the Islamic Republic of Pakistan and the Fund. The terms and conditions of the Commodity Loan as well as the procedures for its utilization will be governed by the said loan agreement which will contain, inter alia, the following principles:
(a) 償還期間は、七年の据置期間の後十八年とする。
(a) The repayment period will be eighteen (18) years after the grace period of seven (7) years.
(b) 利子率は、年二・五パーセントとする。
(b) The rate of interest will be two and a half (2.5) per cent per annum.
(c) 支出期間は、借款契約の発効の日から二年とする。
(c) The disbursement period will be two (2) years from the date of coming into force of the loan agreement.
(2) (1)(c)にいう支出期間は、両政府の関係当局の同意を得て延長することができる。
(2) The disbursement period mentioned in sub-paragraph (1) (c) above may be extended with the consent of the authorities concerned of the two Governments.
3(1) 商品借款は、パキスタン回教共和国内の輸入者が調達適格国の供給者に対して行う支払で、両政府の関係当局間で相互に合意する生産物の購入及び当該生産物の購入に付随する役務の購入のために当該輸入者と当該供給者との間で既に締結されたか又は締結されることのある契約に基づいて行われるものを対象として使用に供される。ただし、当該購入は、調達適格国において、それらの国で生産される生産物及びそれらの国から供給される役務について行われる。
3.(1) The Commodity Loan will be made available to cover payments to be made to suppliers of eligible source countries by importers in the Islamic Republic of Pakistan under such contracts as have been or may be entered into between them for purchases of such products as will be mutually agreed upon between the authorities concerned of the two Governments and for purchases of services incidental to the purchases of those products, provided that such purchases are made in such eligible source countries for products produced in and services supplied from those countries.
(2) 商品借款は、パキスタン回教共和国内の輸入者が調達適格国の供給者に対して千九百八十八年十二月七日より借款契約発効の前日までの間に既に行ったか又は行われる支払で、(1)にいう生産物の購入のために当該輸入者と当該供給者との間で既に締結されたか又は締結されることのある契約に基づいて行われるものを対象として使用に供される。ただし、当該購入は調達適格国において、それらの国で生産される生産物及びそれらの国から供給される役務について行われる。
(2) The Commodity Loan will also be made available to cover payments already made or to be made between December 7th, 1988 and the previous day of coning into force of the loan agreement to suppliers of eligible source countries by importers in the Islamic Republic of Pakistan under such contracts as have been or may be entered into between them for purchases of such products mentioned in sub-paragraph (1) above and for the purchases of services incidental to the purchases of those products, provided that such purchases are made in such eligible source countries for products produced in and services supplied from those countries.
(3) (1)及び(2)にいう調達適格国の範囲は、両政府の関係当局間で合意される。
(3) The scope of eligible source countries mentioned in sub-paragraph (1) and (2) above will be agreed upon between the authorities concerned of the two Governments.
4(1) パキスタン回教共和国政府は、パキスタン回教共和国政府の名義でパキスタン中央銀行に開設された見返資金勘定に同銀行が商品借款の円による支出額に等しい額をパキスタン通貨で振り替えるようにするための措置をとる。このようにして振り替えられたパキスタン通貨は、パキスタン回教共和国政府の洪水災害救済のための経済再建政策及び洪水災害防止計画に基づく事業計画並びに基金が供与する円貨による借款に基づいて実施されるパキスタン回教共和国政府の開発事業計画の現地通貨の需要に充てるために使用されなければならない。開発事業計画を含めたこのような事業計画は両政府の関係当局間で合意される。
4.(1) The Government of the Islamic Republic of Pakistan will take measures to have the equivalent in Pakistani currency of the amount of yen disbursements of the Commodity Loan transferred by the State Bank of Pakistan to the counterpart fund account opened in the name of the Government of the Islamic Republic of Pakistan in the State Bank of Pakistan. The amount of Pakistani currency thus transferred shall be used to cover local currency requirements of the projects under the economic reconstruction policies for flood disaster relief and the flood disaster preparedness program of the Government of the Islamic Republic of Pakistan, and the development projects of the Government of the Islamic Republic of Pakistan implemented under loans in Japanese yen by the Fund. The said projects, including the development projects, will be agreed upon between the authorities concerned of the two Governments.
(2) パキスタン回教共和国政府は、日本国政府に対し、(1)にいう見返資金の使用についての報告を提出する。
(2) The Government of the Islamic Republic of Pakistan will furnish the Government of Japan with reports on the use of the counterpart fund mentioned in sub-paragraph (1) above.
5 パキスタン回教共和国政府は、3(1)及び(2)にいう生産物又は役務が基金の調達のためのガイドライン(国際入札の手続が適用できないか又は適当でない場合を除くほか、なかんずく従うべき国際入札の手続を定める。)に従って調達されることを確保する。
5. The Government of the Islamic Republic of Pakistan will ensure that products and/or services mentioned in sub-paragraph (1) and (2) of paragraph 3 are procured in accordance with the guidelines for procurement of the Fund, which set forth, inter alia, the procedures of international tendering to be followed except where such procedures are inapplicable or inappropriate.
6 両政府は、商品借款に基づいて購入される生産物の海上輸送及び海上保険に関し、それぞれの国の関係法令の範囲内で、両国の海運会社及び海上保険会社の間の公正かつ自由な競争を妨げることのあるいかなる制限も課さない。
6. With regard to the shipping and marine insurance of products purchased under the Commodity Loan, the two Governments will refrain, within the scope of the relevant laws and regulations of the respective countries, from imposing any restrictions that may hinder fair and free competition between the shipping and marine insurance companies of the two countries.
7 パキスタン回教共和国政府は、基金について、商品借款並びにそれらから生ずる利子に対して又はそれらに関連してパキスタン回教共和国において課されるすべての財政課徴金又は租税を免除する。
7. The Government of the Islamic Republic of Pakistan will exempt the Fund from all fiscal levies or taxes imposed in the Islamic Republic of Pakistan on and/or in connection with the Commodity Loan as well as interest accruing therefrom.
8 パキスタン回教共和国政府は、商品借款が、適正にかつ専ら3(1)及び(2)にいう生産物又は役務を購入するために使用されることを確保するために必要な措置をとる。
8. The Government of the Islamic Republic of Pakistan will take necessary measures to ensure that the Commodity Loan be used properly and exclusively for purchases of products and/or services mentioned in sub-paragraph (1) and (2) of paragraph 3.
9 両政府は、前記の了解から又はそれに関連して生ずることのあるいかなる事項についても相互に協議する。
9. The two Governments will consult with each other in respect of any matter that may arise from or in connection with the foregoing understanding.
本使は、閣下が前記の了解をパキスタン回教共和国政府に代わって確認されれば幸いであります。
I should be grateful if Your Excellency would confirm the foregoing understanding on behalf of the Government of the Islamic Republic of Pakistan.
