円借款の供与に関する日本国政府とナイジェリア連邦共和国政府との間の交換公文

Lagos, March 10, 1989
書簡をもって啓上いたします。本使は、日本国とナイジェリア連邦共和国との間の友好関係及び経済協力を強化することを目的として、資金還流措置の下で供与される日本国の商品借款に関して日本国政府の代表者とナイジェリア連邦共和国政府の代表者との間で最近到達した次の了解を確認する光栄を有します。
Excellency, I have the honour to confirm the following understanding recently recently between the representatives of the Government of Japan and of the Government of the Federal Republic of Nigeria concerning a Japanese commodity loan to be extended under the Financial Recycling Scheme with a view to strengthening the friendly relations and economic cooperation between the two countries:
1 二百五十億四千六百万円(二五、〇四六、〇〇〇、〇〇〇円)の額までの円貨による商品借款(以下「商品借款」という。)が、貨易投資政策調整計画(以下「計画」という。)を支援するため、海外経済協力基金(以下「基金」という。)により、日本国の関係法令に従って、ナイジェリア連邦共和国政府に供与されることになる。
1. A commodity loan in Japanese yen up to the amount of twenty-five billion and forty-six billion and forty-six million yen (25,046,000,000) (hereinafter referred to as "the Commodity Loan") will be extended to the Government of the Federal Republic of Nigeria by the Overseas Economic Cooperation Fund (hereinafter referred to as "the Fund") in accordance with the relevant laws and regulations of Japan to support the Trade and Investment Policy Adjustment Program (hereinafter referred to as "the Program").
2(1) 商品借款は、ナイジェリア連邦共和国政府と基金との間に締結される借款契約に基づいて使用に供される。商品借款の条件及び使用に関する手続は、なかんずく次の原則を含むことになる前記の借款契約によって規制される。
2.(1) The commodity Loan will be made available by a loan agreement to be concluded between the Government of the Federal Republic of Nigeria and the Fund. The terms and conditions of the Commodity Loan as well as the procedures for its utilization will be governed by the said loan agreement which will contain, inter alia, the following principles:
(a) 償還期間は、十年の据置期間の後二十年とする。
(a) The repayment period will be twenty (20) years after the grace period of ten (10) years.
(b) 利子率は、年二・九パーセントとする。
(b) The rate of interest will be two and nine-tenths (2.9) per cent per annum.
(c) 支出期間は、借款契約の発効の日から二年とする。
(c) The disbursement period will be two (2) years from the date of coming into force of the loan agreement.
(2) (1)(c)にいう支出期間は、両政府の関係当局の同意を得て延長することができる。
(2) The disbursement period mentioned in sub-paragraph (1) (c) above may be extended with the consent of the authorities concerned of the two Governments.
3(1) 商品借款は、ナイジェリア連邦共和国内の輸入者が調達適格国の供給者に対する支払で、計画の実施中に必要な生産物の購入及び当該生産物の購入に付随する役務の購入のために当該輸入者と当該共給者との間で既に締結されたか又は締結されることのある契約に基づいて行われるものを対象といて使用に供される。ただし、当該購入は、調達適格国において、それらの国で生産される生産物及びそれらの国から供給される役務について行われる。
3.(1) The Commodity Loan will be made available to cover payments to be made to suppliers of eligible source countries by importers in the Federal Republic of Nigeria under such contracts as have been or may be entered into between them for purchases of products to be required during the implementation of the Program and for purchases of services incidental to the purchases of those products, provided that such purchases are made in such eligible source countries for products produced in and services supplied from those countries.
(2) (1)にいう調達適格国の範囲は、両政府の関係当局間で合意される。
(2)T he scope of eligible source countries mentioned in sub-paragraph (1) above will be agreed upon between the authorities concerned of the two Governments.
4(1) ナイジェリア連邦共和国政府は、ナイジェリア連邦共和国政府の名義でナイジェリア中央銀行に開設される見返資金勘定に同銀行が商品借款の円貨による支出額に等しい額をナイジェリア通貨で振り替えるようにするための措置をとる。このようにして振り替えられたナイジェリア通貨は、ナイジェリア連邦共和国政府の経済社会開発事業計画のために使用されなければならない。
4.(1) The Government of the Federal Republic of Nigeria will take measures to have the equivalent in Nigerian currency of the amount of yen disbursements of the Commodity Loan transferred by the Central Bank of Nigeria to the counterpart fund account opened in the name of the Government of the Federal Republic of Nigeria in the Central Bank of Nigeria. The amount of Nigerian currency thus transferred shall be used for the economic and social development projects of the Government of the Federal Republic of Nigeria.
(2) ナイジェリア連邦共和国は、要請に応じ、日本国政府に対し、(1)にいう見返資金の使用についての報告を提出する。
(2) The Government of the Federal Republic of Nigeria will, upon request, furnish the Government of Japan with reports on the use of the counterpart fund mentioned in sub-paragraph (1) above.
5 ナイジェリア連邦共和国政府は、3(1)にいう生産物又は役務が基金の調達のためのガイドライン(国際入札の手続が適用できないか又は適当でない場合を除くほか、なかんずく従うべき国際入札の手続を定める。)に従って調達されることを確保する。
5. The Government of the Federal Republic of Nigeria will ensure that products and/or services mentioned in sub-paragraph (1) of paragraph 3 are procured in accordance with the guidelines for procurement of the Fund, which set forth, inter alia, the procedures of international tendering to be followed except where such procedures are inapplicable or inappropriate.
6 両政府は、商品借款に基づいて購入される生産物の海上輸送及び海上保険に関し、それぞれの国の関係法令の範囲内で、両国の海運会社及び海上保険会社の公正かつ自由な競争を妨げることのあるいかなる制限も課さない。
6. With regard to the shipping and marine insurance of products purchased under the Commodity Loan, the two Governments will refrain, within the scope of the relevant laws and regulations of the respective countries, from imposing any restrictions that may hinder fair and free competition of the shipping and marine insurance companies of the two countries.
7 ナイジェリア連邦共和国政府は、基金について、商品借款及びそれから生ずる利子に対して又はそれらに関連してナイジェリア連邦共和国において課されるすべての財政課徴金又は租税を免除する。
7. The Government of the Federal Republic of Nigeria will exempt the Fund from all fiscal levies or taxes imposed in the Federal Republic of Nigeria on and/or in connection with the Commodity Loan as well as interest accruing therefrom.
8 ナイジェリア連邦共和国政府は、商品借款が、適正にかつ専ら3(1)にいう生産物又は役務を購入するために使用されることを確保するために必要な措置をとる。
8. The Government of the Federal Republic of Nigeria will take necessary measures to ensure that the Commodity Loan be used properly and exclusively for purchases of products and/or services mentioned in sub-paragraph (1) of paragraph 3.
9 ナイジェリア連邦共和国政府は、要請に応じ、日本国政府及び基金に対し、計画の実施の進捗状況に関する情報及び資料を提供する。
9. The Government of the Federal Republic of Nigeria will, upon request, furnish the Government of Japan and the Fund with information and data concerning the progress of the implementation of the Program.
10 両政府は、前記の了解から又はそれに関連して生ずることのあるいかなる事項についても相互に協議する。
10. The two Governments will consult with each other in respect of any matter that may arise from or in connection with the foregoing understanding.
本使は、閣下が前記の了解をナイジェリア連邦共和国政府に代わって確認されれば幸いであります。
I should be grateful if Your Excellency would confirm the foregoing understanding on behalf of the Government of the Federal Republic of Nigeria.
