円借款の供与に関する日本国政府とマリ共和国政府との間の交換公文

書簡をもって啓上いたします。本使は、国際開発協会(以下「協会」という。)理事会の千九百八十五年五月二十一日付け決議第八十五－一号(以下「決議」という。)により設置されたサハラ以南アフリカのための特別基金(以下「アフリカ基金」という。)との特別協調融資として行われる円貨による借款(以下「SJF借款」という。)及び拠出金(以下「SJF拠出金」という。)の使用に関する千九百八十六年八月十九日付けの日本国政府と協会との間の交換公文に言及する光栄を有します。
Excellency, I have the honour to refer to the Exchange of Notes between the Government of Japan and the International Development Association (hereinafter referred to as "the Association") dated August 19,1986 concerning the provision of loans in Japanese yen (hereinafter referrea to as "the SJF Loan") and the use of a contribution (hereinafter referred to as "the SJF contribution") by way of special joint financing with a Special Facility for Sub-Saharan Africa (hereinafter referred to as "the African Facility") established by Resolution No. 85-1 dated May 21,1985 (hereinafter referred to as "the Resolution") of the Executive Directors of the Association.
本使は、更に、日本国政府のアフリカ基金との特別協調融資の一部として、また、日本国とマリ共和国との間の友好関係及び経済協力を強化することを目的として供与される日本国の借款に関して日本国政府の代表者とマリ共和国政府の代表者との間で最近到達した次の了解を確認する光栄を有します。
I have further the honour to confirm the following understanding recently reached between the representatives of the Government of Japan and of the Government of Republic of Mali concerning a Japanese loan to be extended as a part of the special joint financing of the Government of Japan with the African Facility and with a view to strengthening the friendly relations and economic cooperation between the two countries.
1 四十億円(四、〇〇〇、〇〇〇、〇〇〇円)の額までのSJF借款が、公企業部門調整計画(以下「計画」という。)を実施するため、海外経済協力基金(以下「基金」という。)により、日本国の関係法令に従って、マリ共和国政府に供与されることになる。計画は、また日本国政府が決議第九項(b)に規定する条件を満たすため、総額十億円(一、〇〇〇、〇〇〇、〇〇〇円)の額の日本のSJF拠出金の資金により支援される。
1. The SJF Loan up to the amount of four billion yen (4,000,000,000) will be extended to the Government of the Republic of Mali by the Overseas Economic Cooperation Fund (hereinafter referred to as "the Fund") in accordance with the relevant laws and regulations of Japan for the implementation of the Public Enterprise Sector Adjustment Program (hereinafter referred to as "the Program").The Program shall also be supported by funds from the Japanese SJF Contribution in the amount of one billion yen (1,000,000,000) necessary for the Government of Japan to meet the requirements set forth in paragraph 9(b) of the Resolution.
2(1) SJF借款は、マリ共和国政府と基金との間で締結される借款契約に基づいて使用に供される。SJF借款の条件及び使用に関する手続は、なかんずく次の原則を含むことになる前記の借款契約によって規制される。
2.(1) The SJF Loan will be made available by a loan agreement to be concluded between the Government of the Republic of Mali and the Fund. The terms and conditions of the SJF Loan as well as the procedures for its utilization will be governed by the said loan agreement which will contain, inter alia, the following principles:
(a) 償還期間は、十年の据置期間の後二十年とする。
(a) The repayment period will be twenty (20) years after the grace period of ten (10) years.
(b) 利子率は、年一・二五パーセントとする。
(b) The rate of interest will be one and a quarter (1.25) per cent per annum.
(c) 支出期間は、当該借款契約の署名の日から二年とする。
(c) The disbursement period will be two (2) years from the date of the signing of the loan agreement.
(2) (1)(c)にいう支出期間は、両政府の関係当局の同意を得て延長することができる。
(2) The disbursement period mentioned in sub-paragraph (1)(c) above may be extended with the consent of the authorities concerned of the two Governments.
3(1) SJF借款は、マリ共和国内の輸入者により調達適格国の供給者に対して既に行われたか又は行われる支払で、計画の実施に必要な協会により決定されたか又は決定される生産物又は当該生産物の購入に付随する役務の購入のために当該輸入者と当該供給者との間で締結されたか又は締結されることのある契約に基づいて行われるものを対象として使用に供される。ただし、当該購入は、アフリカ基金の資金からの融資に適用される手続及び慣行に従って、また、調達適格国において、それらの国で生産される生産物及びそれらの国から供給される役務について行われる。
3.(1) The SJF Loan will be made available to cover payments already made or to be made to suppliers of eligible source countries by importers in the Republic of Mali under such contracts as have been or may be entered into between them for purchases of products determined or to be determined by the Association and/or services incidental to the purchases of those products required for the implementation of the Program, provided that such purchases are made in accordance with the procedures and practices applicable to the credits made out of the African Facility's resources and in such eligible source countries for products produced in and services supplied from those countries.
(2) (1)にいう調達適格国の範囲は、両政府の関係当局間で合意される。
(2) The scope of eligible source countries mentioned in sub-paragraph (1) above will be agreed upon between the authorities concerned of the two Governments.
4 マリ共和国政府は、SJF借款に基づいて購入される生産物の海上輸送及び海上保険に関し、両国の海運会社及び海上保険会社の間の公正かつ自由な競争を妨げることのあるいかなる制限も課さない。
4. With regard to the shipping and marine insurance of products purchased under the SJF Loan, the Government of the Republic of Mali will refrain, from imposing any restrictions that may hinder fair and free competition between the shipping and marine insurance companies of the two countries.
5 マリ共和国政府は、基金についてSJF借款及びそれから生ずる利子に対して又はそれらに関連してマリ共和国において課されるすべての財政課徴金又は租税を免除する。
5. The Government of the Republic of Mali will exempt the Fund from all fiscal levies or taxes imposed in the Republic of Mali on and/or in connection with the SJF Loan and interest accruing therefrom.
6 マリ共和国政府は、SJF借款が適正にかつ専ら3(1)にいう生産物又は役務を購入するために使用されることを確保するために必要な措置をとる。
6. The Government of the Republic of Mali will take necessary measures to ensure that the SJF Loan be used properly and exclusively for purchases of products and/or services mentioned in sub-paragraph (1) of paragraph 3.
7 マリ共和国政府は、要請に応じ、日本国政府及び基金に対し、SJF借款の実施の進捗状況に関する情報及び資料を提供する。
7. The Government of the Republic of Mali will, upon request, furnish the Government of Japan and the Fund with information and date concerning the progress of the implementation of the SJF Loan.
8 両政府は、前記の了解から又はそれに関連して生ずることのあるいかなる事項についても相互に協議する。
8. The two Governments will consult with each other in respect of any matter that may arise from or in connection with the foregoing understanding.
本使は、閣下が前記の了解をマリ共和国政府に代わって確認されれば幸いであります。
I should be grateful if Your Excellency would confirm the foregoing understanding on behalf of the Government of the Republic of Mali.
