円借款の供与に関する日本国政府とインドネシア共和国政府との間の交換公文

Jakarta, December 7, 1989
書簡をもって啓上いたします。本使は、インドネシア共和国の経済安定及び開発努力を促進することを目的として供与される千九百八十九年の日本国の借款に関して日本国政府の代表者とインドネシア共和国政府の代表者との間で最近行われた討議に言及するとともに、両政府の間で到達した次の了解を確認する光栄を有します。
Excellency, I have the honour to refer to the recent discussions held between the representatives of the Government of Japan and of the Government of the Republic of Indonesia regarding Japanese loans for 1989 to be extended with a view to promoting the economic stabilization and development efforts of the Republic of Indonesia, and to confirm the following understanding reached between the two Governments:

1 八百十億千百万円(八一、〇一一、〇〇〇、〇〇〇円)の額までの円貨による事業計画借款(以下「借款I」という。)が、この書簡の付表1に掲げる計画を実施するため、各計画につき付表1に定める配分に応じ、海外経済協力基金(以下「基金」という。)により、日本国の関係法令に従って、インドネシア共和国政府に供与されることになる。
1. A project loan in Japanese yen up to the amount of eighty-one billion eleven million yen (81,011,000,000) (hereinafter referred to as "the Loan I") will be extended, in accordance with the relevant laws and regulations of Japan, to the Government of the Republic of Indonesia by the Overseas Economic Cooperation Fund (hereinafter referred to as "the Fund") to implement the projects enumerated in the List 1 attached hereto according to the allocation for each project as specified in the List 1.
2(1) 借款Iは、インドネシア共和国政府と基金との間で締結される借款契約に基づいて使用に供される。借款Iの条件及び使用に関する手続は、なかんずく次の原則を含むことになる前記の借款契約によって規制される。
2.(1) The Loan I will be made available by loan agreements to be concluded between the Government of the Republic of Indonesia and the Fund. The terms and conditions of the Loan I as well as the procedures for its utilization will be governed by the said loan agreements which will contain, inter alia, the following principles:
(a) 償還期間は、十年の据置期間の後二十年とする。
(a) The repayment period will be twenty (20) years after the grace period of ten (10) years.
(b) 利子率は、年二・五パーセントとする。
(b) The rate of interest will be two and a half per cent (2.5%) per annum.
(c) 支出期間は、付表1に掲げる2、3、6、7、9、及び10の計画については、関係借款契約の発効の日から五年とし、付表1に掲げる4及び8の計画については、関係借款契約の発効の日から六年とし、付表1に掲げる1及び5の計画については、関係借款契約の発効の日から七年とする。
(c) The disbursement period will be five (5) years with regard to the projects mentioned in 2, 3, 6, 7, 9 and 10, six (6) years with regard to the projects mentioned in 4 and 8 and seven (7) years with regard to the projects mentioned in 1 and 5 of the List 1 from the date of the coming into force of the relevant loan agreement.
(2) (1)にいう借款契約の各々は、基金が当該借款契約に係る計画の実行可能性を確認した後に締結される。
(2) Each of the loan agreements mentioned in sub-paragraph (1) above will be concluded after the Fund is satisfied of the feasibility of the projects to which such loan agreement relates.
3(1) 借款Iは、インドネシアの実施機関が調達適格国の供給者、請負業者又はコンサルタントに対して行う支払で、付表1に掲げる計画の実施に必要な生産物又は役務の購入のために両者の間で既に締結されたか又は締結されることのある契約に基づいて行われるものを対象として使用に供される。ただし、当該購入は、調達適格国において、それらの国で生産される生産物又はそれらの国から供給される役務について行われる。
3.(1) The Loan I will be made available to cover payments to be made by Indonesian executing agencies to suppliers, contractors and/or consultants of eligible source countries under such contracts as have been or may be entered into between them for purchases of products and/or services required for the implementation of the projects enumerated in the List 1, provided that such purchases are made in such eligible source countries for products produced in and/or services supplied from those countries.
(2) 借款Iの一部は、付表1に掲げる計画の実施のための適格な現地通貨の需要に充てるために使用することができる。
(2) A part of the Loan I may be used to cover eligible local currency requirements for the implementation of the projects enumerated in the List 1.
4 インドネシア共和国政府は、要請に応じ、付表1に掲げる計画の進捗状況についての報告を日本国政府に提出する。
4. The Government of the Republic of Indonesia will, upon request, furnish the Government of Japan with reports on the progress of the projects enumerated in the List 1.
II
II
1 四百五十五億円(四五、五〇〇、〇〇〇、〇〇〇円)の額までの円貨による借款(以下「借款II」という。)が、資金還流措置の下で基金により、日本国の関係法令に従って、インドネシア共和国政府に供与されることになる。
1. A loan in Japanese yen up to the amount of forty-five billion five hundred million yen (45,500,000,000) (hereinafter referred to as "the Loan II") will be extended under the Financial Recycling Scheme, in accordance with the relevant laws and regulations of Japan, to the Government of the Republic of Indonesia by the Fund.
2 借款IIは、インドネシア共和国政府と基金との間で締結される借款契約に基づいて使用に供される。借款IIの条件及び使用に関する手続は、なかんずく次の原則を含むことになる前記の借款契約によって規制される。
2. The Loan II will be made available by a loan agreement to be concluded between the Government of the Republic of Indonesia and the Fund. The terms and conditions of the Loan II as well as the procedures for its utilization will be governed by the said loan agreement which will contain, inter alia, the following principles:
(a) 償還期間は、十年の据置期間の後二十年とする。
(a) The repayment period will be twenty (20) years after the grace period of ten (10) years.
(b) 利子率は、年二・五パーセントとする。
(b) The rate of interest will be two and a half per cent (2.5%) per annum.
(c) 支出期間は、借款契約の発効の日から二年とする。
(c) The disbursement period will be two (2) years from the date of coming into force of the loan agreement.
3(1) 借款IIは、インドネシア共和国内の輸入者による調達適格国の供給者に対する支払で、両政府の関係当局間で相互に合意する表に掲げる生産物の購入及び当該生産物の購入に付随する役務の購入のために当該輸入者と当該供給者との間で既に締結されたか又は締結されることのある契約に基づいて行われるものを対象として使用に供される。ただし、当該購入は、調達適格国において、それらの国で生産される生産物及びそれらの国から供給される役務について行われる。
3.(1) The Loan II will be made available to cover payments to suppliers of eligible source countries by importers in the Republic of Indonesia under such contracts as have been or may be entered into between them for purchases of such products as will be enumerated in a list to be mutually agreed upon between the authorities concerned of the two Governments and for purchases of services incidental to the purchases of those products, provided that such purchases are made in such eligible source countries for products produced in and services supplied from those countries.
(2) (1)にいう表には、両政府の関係当局間の合意によって修正を加えることができる。
(2) The list mentioned in sub-paragraph (1) above may be modified by agreement between the authorities concerned of the two Governments.
4(1) インドネシア共和国政府は、インドネシア共和国政府の名義でインドネシア銀行に開設された見返資金勘定に借款IIの円貨による支出額に等しい額をインドネシア通貨で振り替えるようにするための措置をとる。このようにして振り替えられたインドネシア通貨は、基金が供与する円貨による借款に基づいて実施されるインドネシア共和国の開発事業計画の現地通貨の需要に充てるために使用されなければならない。ただし、両政府の関係当局が当該インドネシア通貨をインドネシア共和国の他の開発事業計画に使用することができる旨合意する場合は、この限りてない。
4.(1) The Government of the Republic of Indonesia will take measures to have the equivalent in Indonesian currency of the amount of yen disbursements of the Loan II transferred into the counterpart fund account opened in the name of the Government of the Republic of Indonesia at Bank Indonesia. The amount of Indonesian currency thus transferred shall be used to cover local currency requirements of the development projects of the Republic of Indonesia implemented under loans in Japanese yen by the Fund, except where the authorities concerned of the two Governments agree that the said amount of Indonesian currency may be used for other development projects of the Republic of Indonesia.
(2) インドネシア共和国政府は、要請に応じ、日本国政府に対し、(1)にいう見返資金の使用についての報告を提出する。
(2) The Government of the Republic of Indonesia will, upon request, furnish the Government of Japan with reports on the use of the counterpart fund mentioned in sub-paragraph (1)above.

1 三百二十五億円(三二、五〇〇、〇〇〇、〇〇〇円)の額までの円貨によるセクターグラム借款(以下「借款III」という。)が、この書簡の付表2に掲げるセクターの開発のため、資金還流措置の下で基金により、日本国の関係法令に従って、インドネシア共和国政府に供与されることになる。
1. A sector program loan in Japanese yen up to the amount of thirty-two billion five hundred million yen (32,500,000,000) (hereinafter referred to as "the Loan III") will be extended under the Financial Recycling Scheme, in accordance with the relevant laws and regulations of Japan, to the Government of the Republic of Indonesia by the Fund for the development of the sectors enumerated in the List 2 attached hereto.
2 借款IIIは、インドネシア共和国政府と基金との間で締結される借款契約に基づいて使用に供される。借款IIIの条件及び使用に関する手続は、なかんずく次の原則を含むことになる前記の借款契約によって規制される。
2. The Loan III will be made available by a loan agreement to be concluded between the Government of the Republic of Indonesia and the Fund. The terms and conditions of the Loan III as well as the procedures for its utilization will be governed by the said loan agreement which will contain, inter alia, the following principles:
(a) 償還期間は、十年の据置期間の後二十年とする。
(a) The repayment period will be twenty (20) years after the grace period of ten (10) years.
(b) 利子率は、年二・五パーセントとする。
(b) The rate of interest will be two and a half per cent (2.5%) per annum.
(c) 支出期間は、借款契約の発効の日から二年とする。
(c) The disbursement period will be two (2) years from the date of coming into force of the loan agreement.
3(1) 借款IIIは、インドネシア共和国内の輸入者による調達適格国の供給者に対する支払で、両政府の関係当局間で相互に合意する表に掲げる生産物の購入及び当該生産物の購入に付随する役務の購入のために当該輸入者と当該供給者との間で既に締結されたか又は締結されることのある契約に基づいて行われるものを対象として使用に供される。ただし、当該購入は、調達適格国において、それらの国で生産される生産物及びそれらの国から供給される役務について行われる。
3.(1) The Loan III will be made available to cover payments to suppliers of eligible source countries by importers in the Republic of Indonesia under such contracts as have been or may be entered into between them for purchases of such products as will be enumerated in a list to be mutually agreed upon between the authorities concerned of the two Governments and for purchases of services incidental to the purchases of those products, provided that such purchases are made in such eligible source countries for products produced in and services supplied from those countries.
(2) (1)にいう表には、両政府の関係当局間の合意によって修正を加えることができる。
(2) The list mentioned in sub-paragraph (1) above may be modified by agreement between the authorities concerned of the two Governments.
4(1) インドネシア共和国政府は、インドネシア共和国政府の名義でインドネシア銀行に開設された見返資金特別勘定(以下「特別勘定」という。)に借款IIIの円貨による支出額に等しい額をインドネシア通貨で振り替えるようにするための措置をとる。1にいう各々のセクターについて、副勘定が特別勘定の中に設置される。
4.(1) The Government of the Republic of Indonesia will take measures to have the equivalent in Indonesian currency of the amount of yen disbursements of the Loan III trans-ferred into the counterpart fund special account (hereinafter referred to as "the Special Account") opened in the name of the Government of the Republic of Indonesia at Bank Indonesia. A sub-account will be set up in the Special Account for each sector mentioned in paragraph 1 respectively.
(2) このようにして振り替えられた見返資金は、インドネシア共和国政府により、付表2にいう配分に従い円貨の額に等しい額までのインドネシア通貨により、当該セクターの各々の副勘定に配分される。インドネシア共和国政府は、日本国政府に対し、見返資金の配分の進捗状況を遅滞なく報告する。
(2) The counterpart fund thus trasferred will be allocated by the Government of the Republic of Indonesia to each sub-account of the corresponding sector in Indonesian currency up to the amount equivalent to the amount of yen according to the allocation as mentioned in the List 2. The Government of the Republic of Indonesia shall duly inform the Government of Japan on the progress of the allocation of the counterpart fund.
(3) 配分された見返資金は、各々のセクターの現地通貨の需要に充てるために使用される。インドネシア共和国政府は基金に対し、見返資金の使用についての通知を提出する。
(3) The allocated counterpart fund will be used to cover local currency requirements of the corresponding sectors. The Government of the Republic of Indonesia will submit to the Fund the notice of the counterpart fund financing.
(4) 付表2にいう配分は、両政府の関係当局間の合意によって修正を加えることができる。
(4) The allocation as mentioned in the List 2 may be modified by agreement between the authorities concerned of the two Government.

IV
1 I2(1)(c)、II2(c)及びIII2(c)にいうそれぞれの支出期間は、両政府の関係当局の同意を得て延長することができる。
1. The respective disbursement period mentioned in sub-paragraph (1) (c), paragraph 2 of part I, sub-paragraph (c), paragraph 2 of part II and sub-paragraph (c), paragraph 2 of part III may be extended with the consent of the authorities concerned of the two Governments.
2 I3(1)、II3(1)及びIII3(1)にいう調達適格国のそれぞれの範囲は、両政府の関係当局間で合意される。
2. The respective scopes of eligible source countries mentioned in sub-paragraph (1), paragraph 3 of part I, sub-paragraph (1), paragraph 3 of part, II and sub-paragraph (1), paragraph 3 of part III will be agreed upon between the authorities concerned of the two Governments.
3 インドネシア共和国政府は、I3(1)、II3(1)及びIII3(1)にいう生産物又は役務が基金の調達のためのガイドライン(国際入札の手続が適用できないか又は適当でない場合を除くほか従うべき国際入札の手続をなかんずく定める。)に従って調達されることを確保する。
3. The Government of the Republic of Indonesia will ensure that products and/of services mentioned in sub-paragraph (1), paragraph 3 of part I, sub-paragraph (1), paragraph 3 of part II and sub-paragraph (1), paragraph 3 of part III are procured in accordance with the guidelines for procurement of the Fund, which set forth, inter alia, the procedures of international tendering to be followed except where such procedures are inapplicable of inappropriate.
4 両政府は、借款I、借款II及び借款IIIに基づいて購入される生産物の海上輸送及び海上保険に関し、それぞれの国の関係法令の範囲内で、それぞれの国の海運会社及び海上保険会社の間の公正かつ自由な競争を妨げることのあるいかなる制限も課さない。
4. With regard to the shipping and marine insurance of products purchased under the Loan I, the Loan II and the Loan III, the tow Governments will refrain, within the scope of the relevant laws and regulations of their respective countries, from imposing any restrictions that may hinder fair and free competition between the shipping and marine insurance companies of the respective countries.
5(1) インドネシア共和国政府は、基金について、借款I、借款II及び借款III並びにそれらから生ずる利子に対して又はそれらに関連して課されるインドネシアの財政課徴金又は租税を免除する。
5.(1) The Government of the Republic of Indonesia will exempt the Fund from Indonesian fiscal levies or taxes on and/or in connection with the Loan I, the Loan II and the Loan III as well as interest accruing therefrom.
(2) インドネシア共和国政府は、供給者、請負業者又はコンサルタントとして活動する日本国の会社が借款Iに基づいて既に提供されたか又は提供される生産物又は役務の供給から取得する所得に関するインドネシアのすべての財政課徴金又は租税を負担する。
(2) The Government of the Republic of Indonesia shall assume all Indonesian fiscal levies or taxes with respect to the income of Japanese companies operating as suppliers, contractors and/or consultants accruing from the supply of products and/or services already provided and/or to be provided under the Loan I.
(3) インドネシア共和国政府は、請負業者又はコンサルタントとして活動する日本国の会社が借款Iの対象として取り上げられる計画の実施のために必要な自己の資材及び設備の輸入及び再輸出に関するインドネシアのすべての関税及びそれに関連する公課を負担する。
(3) The Government of the Republic of Indonesia shall assume all Indonesian duties and related fiscal charges with respect to the import and re-export of own materials and equipment of Japanese companies operating as suppliers, contractors and/or consultants needed for the implementation of the projects taken up for the Loan I.
6 インドネシア共和国政府は、次のことを確保するために必要な措置をとる。
6. The Government of the Republic of Indonesia will take necessary measures to ensure that:
(a) 借款I、借款II及び借款IIIが、適正にかつ専らI3(1)、II3(1)及びIII3(1)のそれぞれにいう生産物又は役務を購入するために使用されること。
(a) the Loan I, the Loan II and the Loan III be used properly and exclusively for purchases of products and/or services mentioned respectively in sub-paragraph (1), paragraph 3 of part I, sub-paragraph (1), paragraph 3 of part II and sub-paragraph (1) paragraph 3 of part III;
(b) 借款Iに基づいて建設される施設が、この了解に定められた目的のために適正にかつ効果的に維持され及び使用されること。
(b) the facilities constructed under the Loan I be maintained and used properly and effectively for the purposes prescribed in this understanding.
7 両政府は、共同して借款I、借款II及び借款IIIの実施の進捗状況を随時検討し、借款I、借款II及び借款IIIの円滑かつ効果的な使用を確保するために必要な措置をとり、また、この了解から又はそれに関連して生ずることのあるいかなる事項についても相互に協議する。
7. The two Governments will jointly review from time to time the progress of the implementation of the Loan I, the Loan II and the Loan III and take necessary measures to secure smooth and effective utilization of the Loan I, the Loan II and the Loan III and otherwise consult with each other in respect of any matter that may arise from or in connection with this understanding.
本使は、閣下が前記の了解をインドネシア共和国政府に代わって確認されれば幸いであります。
I should be grateful if Your Excellency would confirm the foregoing understanding on behalf of the Government of the Republic of Indonesia.
