債務救済措置に関する日本国政府とコスタ・リカ共和国政府との間の交換公文

San Jose, Jose, July 11, 1989
書簡をもって啓上いたします。本使は、千九百八十九年五月二十六日及び二十七日にパリで開催されたコスタ・リカ共和国政府の代表者と関係債権諸国政府の代表者との間の協議において到達した結論に基づき日本国政府の代表者とコスタ・リカ共和国政府の代表者との間で行われた最近の交渉に言及する光栄を有します。本使は、更に、当該交渉において到達した次の了解を確認する光栄を有します。
Excellency,I have the honour to refer to the recent negotiations between the representatives of the Government of Japan and of the Government of the Republic of Costa Rica that were held on the basis of the conclusions reached during the consultations between the representatives of the government of the Republic of Costa Rica and of the Governments of the creditor countries concerned held in Paris on May 26 and 27, 1989. I have further the honour to confirm the following understanding reached in the course of the said negotiations:
1 債務繰延方式による債務救済措置が、日本輸出入銀行(以下「銀行」という。)により、日本国の関係法令に従ってとられることになる。
1. A debt relief measure in the form of rescheduling will be taken by the Export-Import Bank of Japan (hereinafter referred to as "the Bank") in accordance with the relevant laws and regulations of Japan.
2(1) 繰り延べられる債務(以下「繰延債務」という。)は、コスタ・リカ共和国政府が銀行に対して負う次の債務から成り、その内訳は、この書簡の付表に掲げられる。
2.(1) The debts to be rescheduled (herein-after referred to as "the Rescheduled Debts") consist of the following debts owed by the Government of the Republic of Costa Rica to the Bank. The breakdown of the Rescheduled Debts is shown in the List attached hereto:
(a) 過去に繰り延べられなかった債務であって、
(a) The debts not previously rescheduled and:
(i) 千九百八十九年三月三十一日以前に弁済期限が到来し、かつ未払のもの
(i) Having fallen due on and before March 31, 1989 and not paid;
(ii) 千九百八十九年四月一日から千九百九十年五月三十一日までの間(両期日を含む。)に弁済期限が到来したか又は到来するもの
(ii) having fallen or falling due between April 1, 1989 and May 31, 1990, both dates inclusive.
(b) 千九百八十三年六月二十三日及び千九百八十五年六月十八日に日本国政府とコスタ・リカ共和国政府との間で交換された書簡(以下「従前の書簡」という。)に基づき過去に繰り延べられた債務であって、千九百八十九年三月三十一日以前に弁済期限が到来し、かつ未払のもの
(b) The debts previously rescheduled in accordance with the arrangements made by the Notes exchanged between the Governments of Japan and of the Republic of Costa Rica on June 23, 1983 and on June 18, 1985 (hereinafter jointly referred to as "the Notes"), having fallen due on and before March 31, 1989, and not paid.
(c) (a)(i)にいう債務に係る遅延利子であって、当初の弁済期日から千九百八十九年三月三十一日までの間(両期日を含む。)に生じたもの
(c) The late interest on the debts referred to in (a) (i) above, having accrued during the period between each original due date and March 31, 1989 (both dates inclusive).
(d) (b)にいう債務に係る遅延利子であって、従前の書簡に規定された弁済期日から千九百八十九年三月三十一日までの間(両期日を含む。)に生じたもの
(d) The late interest on the debts referred to in (b) above, having accrued during the period between each date of payment stipulated in the Notes and March 31, 1989 (both dates inclusive).
(2)(a) (1)(a)にいう債務の総額は、二十七億千八百七十五万七千二百四円(二、七一八、七五七、二〇四円)になる。
(2)(a) The total amount of the debts referred to in (a) of sub-paragraph (1) above will be two billion seven hundred eighteen million seven hundred fifty-seven thousand two hundred and four yen (2,718,757,204).
(b) (1)(b)にいう債務の総額は、十二億六千七百二十六万六千百三十三円(一、二六七、二六六、一三三円)になる。
(b) The total amount of the debts referred to in (b) of sub-paragraph (1) above will be one billion two hundred sixty-seven million two hundred sixty-six thousand one hundred and thirty-three yen (1,267,266,133).
(c) (1)(c)及び(d)にいう遅延利子の総額は、日本国政府とコスタ・リカ共和国政府の関係当局によってできる限り速やかに算定される。当該期間に適用される利子率は、年五・二五パーセントとする。
(c) The total amount of the late interest referred to in (c) and (d) of sub-paragraph (1)above will be calculated as soon as possible by the authorities concerned of the Governments of Japan and of the Republic of Costa Rica. The rate of interest applied for the period mentioned above is five and a quarter per cent (5.25%) per annum.
(3) (2)にいう総額及びこの書簡の付表は、コスタ・リカ共和国政府の関係当局及び銀行が行う最終的照合の後に日本国政府とコスタ・リカ共和国政府の関係当局間の合意により修正されることがある。
(3) Modifications may be made to the total amount referred to in sub-paragraph (2) above and the List attached hereto by agreement between the authorities concerned of the Governments of Japan and of the Republic of Costa Rica, after the final verification to be made by the authorities concerned of the Government of the Republic of Costa Rica and the Bank.
3 債務繰延べの条件は、コスタ・リカ共和国政府と銀行との間で締結される債務繰延契約であって、なかんずく次の原則を含むものにおいて規定される。
3. The terms and conditions of the rescheduling will be stipulated in rescheduling agreements to be concluded between the Government of the Republic of Costa Rica and the Bank, which will contain, inter alia, the following principles:
(1) 2(1)(a)(i)及び(c)にいう債務の各々は、千九百九十四年三月三十一日に始まる八回の均等半年賦払により支払われる。
(1) Each of the debts referred to in sub-paragraph (1) (a) (i) and (c) of paragraph 2 will be paid in eight (8) equal semi-annual installments beginning on March 31, 1994.
(2) 2(1)(a)(ii)にいう債務の各々は、千九百九十五年四月三十日に始まる十回の均等半年賦払により支払われる。
(2) Each of the debts referred to in sub-paragraph (1) (a) (ii) of paragraph 2 will be paid in ten (10) equal semi-annual installments beginning on April 30, 1995.
(3) 2(1)(b)及び(d)にいう債務の各々は、千九百九十年六月三十日に始まる三回の均等年賦払により支払われる。
(3) Each of the debts referred to in sub-paragraph (1) (b) and (d) of paragraph 2 will be paid in three (3) equal annual installments beginning on June 30, 1990.
(4) 繰延債務に対してこの書簡の付表に掲げる弁済期日又は千九百八十九年三月三十一日のいずれか遅い方の期日からそれぞれ適用される利子率は、年四・七五パーセントとする。
(4) The rate of interest on the Rescheduled Debts will be four and three quarters per cent (4.75%) per annum of the List beginning respectively from the due dates mentioned in the List attached hereto or March 31, 1989, whichever is the later.
本使は、閣下が、前記の了解をコスタ・リカ共和国政府に代わって確認されれば幸いであります。
I should be grateful if Your Excellency would confirm the foregoing understanding on behalf of the Government of the Republic of Costa Rica.
