　La Paz, April 28,1989


　書簡をもって啓上いたします。本使は、千九百八十八年十一月十四日にパリで開催されたボリヴィア共和国政府の代表者と関係債権諸国政府の代表者との間の協議において到達した結論に基づき日本国政府の代表者とボリヴィア共和国政府の代表者との間で行われた最近の交渉に言及する光栄を有します。本使は、更に、当該交渉において到達した次の了解を確認する光栄を有します。

　Excellency,
I have the honour to refer to the recent negotiations between the representatives of the Government of Japan and of the Government of the Republic of Bolivia that were held on the basis of the conclusions reached during the consultations between the representatives of the Government of the Republic of Bolivia and of the Governments of the creditor countries concerned held in Paris on 14 November, 1988. I have further the honour to confirm the following understanding reached in the course of the said negotiations:


1　債務繰延方式による債務救済措置が、海外経済協力基金(以下「基金」という。)により、日本国の関係法令に従ってとられることになる。

1. A debt relief measure in the form of rescheduling will be taken by the Overseas Economic Cooperation Fund (hereinafter referred to as "the Fund")  in accordance with the relevant laws and regulations of Japan.


2(1)　繰り延べられる債務(以下「繰延債務」という。)は、ボリヴィア共和国政府が基金に対して負う次の債務から成る。(a)及び(b)にいう債務の内訳は、この書簡の付表に掲げられる。

2.(1) The debts to be rescheduled (hereinafter referred to as "the Rescheduled Debts") consist of the following debts owed by the Government of the Republic of Bolivia to the Fund. The breakdown of the debts referred to in (a) and (b) below is shown in the List attached hereto:


(a)　千九百八十八年十月一日から千九百八十九年十二月三十一日までの間(両期日を含む。)に弁済期限の到来したか又は到来する債務で、その額は、二十四億五千六百八十七万九千百九十円(二、四五六、八七九、一九〇円)になる。

(a) The debts having fallen or falling due between 1 October, 1988 and 31 December, 1989 (both dates inclusive), the amount of which will be two billion four hundred fifty-six million eight hundred seventy-nine thousand one hundred and ninety Japanese Yen (2,456,879,190).


(b)　千九百八十八年九月三十日以前に弁済期限が到来し、かつ未払の債務で、その額は、十七億八千五百二十万八百十一円(一、七八五、二〇〇、八一一円)になる。

(b) The debts having fallen due on and before 30 September, 1988, and not paid, the amount of which will be one billion seven hundred eighty-five million two hundred thousand eight hundred and eleven Japanese Yen (1,785,200,811).


(c)　(b)にいう債務に係る利子であって、当初の弁済期日から千九百八十八年九月三十日までの間(両期日を含む。)に生じたもの。その額は、日本国政府とボリヴィア共和国政府の関係当局によってできる限り速やかに算定される。当該期間に適用される利子率は、3(2)にいう利子率に等しい。

(c) The interest on the debts referred to in (b)  above, having accrued during the period between the original due date and 30 September, 1988 )both dates inclusive). The amount will be calculated as soon as Possible by the authorities concerned of the Government of Japan and the Government of the Republic of Bolivia. The rate of interest applied for the period mentioned above is equal to the rate of interest referred to in sub-paragraph (2) of paragraph 3.


(2)　(1)(a)及び(b)にいう額及びこの書簡の付表は、ボリヴィア共和国政府の関係当局及び基金が行う最終的照合の後に日本国政府とボリヴィア共和国政府の関係当局間の合意により修正されることがある。

(2) Modifications may be made to the amount of the debts referred to in Sub-paragraph (1) (a) and (b) above and the List attached hereto by agreement between the authorities concerned of the Government of Japan and of the Government of the Republic of Bolivia, after the final verification to be made by the authorities concerned of the Government of the Republic of Bolivia and the Fund.


3　債務繰延べの条件は、ボリヴィア共和国政府と基金との間で締結される債務繰延契約であって、なかんずく次の原則を含むものにおいて規定される。

3. The terms and conditions of the rescheduling will be stipulated in rescheduling agreements to be concluded between the Government of the Republic of Bolivia and the Fund, which will contain, inter alia, the following principles:


(1)　2(1)にいう債務の各々は、千九百九十五年十一月十五日に始まる八回の均等半年賦払により支払われる。

(1) Each of the debts mentioned in subparagraph (1) of paragraph 2 will be paid in eight (8) equal semi-annual installments beginning on 15 November, 1995.


(2)　繰延債務に対して2(1)(a)にいう債務については当初の弁済期日から、また、2(1)(b)にいう債務及び2(1)(c)にいう利子については千九百八十八年十月一日からそれぞれ適用される利子率は、年三・七パーセントとする。

(2) The rate of interest on the Rescheduled Debts will be three point seven per cent (3.7%) Per annum beginning respectively from original due dates for the debts referred to in Sub-paragraph (1) (a) of paragraph 2 or 1 October, 1988 for the debts referred to in Sub-paragraph (1) (b) of paragraph 2 and the interest referred to in sub-paragraph (1) (c) of the said paragraph.

1(1)　この取極は、一方においてボリヴィア共和国政府及び政府企業並びにボリヴィアの民間団体(以下「債務者」という。)と他方において日本国の居住者である関係債権者(以下「債権者」という。)との間で千九百八十五年十二月三十一日以前に契約され、日本国政府が保険を引き受けた次の商業上の債務であって、過去に繰り延べられていないもの又は千九百八十七年三月三十一日に日本国政府とボリヴィア共和国政府との間で交換された書簡に基づき過去に繰り延べられたもの(以下「繰延商業債務」という。)の総額に適用される。


							

						

						

							

								
1.(1) The present arrangements will apply to the total amount of the following commercial debts contracted before 31 December, 1985 between the Government and governmental corporations of the Republic of Bolivia and Bolivian private entities (hereinafter referred to as "the Debtors") on the one hand and the creditors concerned resident in Japan (hereinafter referred to as "the Creditors") on the other and insured by the Government of Japan, as not previously rescheduled or previously rescheduled pursuant to the arrangements made by the Notes exchanged between the Government of Japan and the Government of the Republic of Bolivia on 31 March, 1987 (hereinafter referred to as "the Rescheduled Commercial Debts"):

3.(1) The Government of the Republic of Bolivia will pay to the Creditors, on 15 May and 15 November each year, interest to be calculated as described in sub-paragraph (2) below on each of the commercial debts concerned to the extent payment of interest will be made on 15 November, 1989.


							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
(2)(a)　繰延商業債務に対する支払計画上の利子率は、合衆国ドルによって契約された商業上の債務については年八・八パーセント、日本円によって契約された商業上の債務については年六・五パーセントとする。


							

						

						

							

								
(2)(a) The rate of interest on the Rescheduled Commercial Debts applied for the Payment Scheme will be eight point eight percent (8.8%) per annum for the commercial debts contracted in United States dollars and six point five per cent (6.5%) per annum for the commercial debts contracted in Japanese yen.


							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
(b)　支払われる利子の額は、未決済の債務の額に当該債務が決済されないままに経過した日数及び一日当たりの利子率を乗じて算定される。一日当たりの利子率は、(a)にいう利子率を三百六十五で除して算定される。前記の算定方法を算式で表したものが、この書簡の付表IIに掲げられる。


							

						

						

							

								
(b) The amount of interest to be paid will be calculated by multiplying the amount of the debt unsettled by the product of the number of the days the debt has not been settled and the daily interest rate. The daily interest rate is calculated by dividing the rate of interest referred to in (a) above by three hundred and sixty-five (365). The illustration in the form of numerical formula of the method of calculation mentioned above is shown in the Annex II Attached to this Note.


							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
(3)　支払われる利子については、ボリヴィア共和国のすべての租税及び課徴金が免除される。

4　ボリヴィア共和国政府は、商業上の関係債務の決済に伴って生ずる銀行手数料を支払う。


							

						

						

							

								
4. The Government of the Republic of Bolivia will pay bank charges incidental to the settlement of the commercial debts concerned.


							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
5　債務者が支払計画に従って商業上の関係債務を決済するためボリヴィア共和国において必要とされる措置をとらなかった場合には、ボリヴィア共和国政府は、当該債務が債務者と債権者との間で関係契約に従って決済されることを、ボリヴィア共和国において施行されている関係法令の範囲内で確保する。ボリヴィア共和国政府は、また、関係契約によって指定された通貨による商業上の関係債務の支払金の自由な移転を保証する。


							

						

						

							

								
5. If the Debtors fail to take such measures as are required in the Republic of Bolivia for the settlement of the commercial debts concerned in accordance with the Payment Scheme, the Government of the Republic of Bolivia will guarantee, within the scope of the relevant laws and regulations in force in the Republic of Bolivia, the settlement between the Debtors and the Creditors of such commercial debts in accordance with the contracts concerned. The Government of the Republic of Bolivia will also guarantee the free transfer of payments of the commercial debts concerned in any currency or currencies designated in the contracts concerned.


							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
6　関係契約の条件のうちこの書簡において特に言及されていないものは、関係契約の当事者間で別段の合意がある場合を除くほか、引き続き適用されることが確認される。


							

						

						

							

								
6. It is confirmed that the terms and conditions of the contracts concerned not specifically referred to in this Note will remain applicable, unless otherwise agreed upon by the parties to the contracts concerned.


							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
7　ボリヴィア共和国政府は、いずれかの第三国の居住者である債権者に対し債務救済措置について2(4)にいう条件より有利な条件を与えた場合には、当該第三国の居住者である債権者に与えられる条件より不利でない条件を、債権者に直ちに与える。


							

						

						

							

								
7. If the Government of the Republic of Bolivia accords to creditors resident in any third country terms and conditions more favourable than those referred to in paragraph 2(4) with regard to debt relief measures, the Government of the Republic of Bolivia will forthwith accord to the Creditors the terms and conditions not less favourable than those accorded to creditors resident in such third country.
