国際組織犯罪防止条約

国際組織犯罪防止条約につき、我が国においては、2003年5月に条約締結について国会の承認が得られていますが、条約を実施するための国内法が国会で成立していないため、我が国政府として条約を締結するには至っていない状況にあります。
本年9月19日、コスタ国連薬物犯罪事務所（UNODC）事務局長より麻生太郎外務大臣に対し、本条約の早期締結を求める書簡が接到しました。同書簡において、コスタ事務局長は、本条約を未だ批准していない最後の政治経済大国の一つである日本が、可能な限り早期に本条約及びその議定書の締約国となり、これらの条約を完全に履行することは、日本のみならず国際社会全体にとって極めて重要であると信じており、このような期待をすべての関係者と共有してほしい旨述べています。
書簡の内容（原文及び日本語仮訳）は以下のとおりです。
During my official visit to Japan on 4 to 6 July this year, I had the opportunity to meet with representatives of the Japanese Government, including your Vice-Minister, Professor Akiko Yamanaka. I presented UNODCユs new mandates that are related, in particular, to transnational organized crime and was happy to detect the strong commitment of Japan to support the work of UNODC and to place itself at the forefront of international efforts to combat organized crime. It is in that context that I have the honour to bring to your attention the forthcoming session of the Conference of the Parties to the United Nations Convention against Transnational Organized Crime.
The Conference has met twice since the entry into force of the Convention in 2003 and will hold its third session from 9 to 18 October 2006 in Vienna. Allow me, Excellency, to share with you my strong feeling that it would be regrettable if Japan would not be able to participate in the Conference with the status of State Party to the Convention. As a full-fledged member of the Conference, Japan would be in the best position to fulfil its role as one of the global powers leading the efforts of the international community in combating organized crime and realizing a more secure world under the rule of law.
The Convention together with its Protocols, as you are well aware, is the only existing universal legal framework for international cooperation against organized crime and for fighting against such heinous crimes as human trafficking. I believe it is of utmost importance, not only for Japan but also for the international community as a whole, that Japan, one of the last major political and economic powers yet to ratify the Convention, becomes party to the Convention and its Protocols and fully implements these instruments as soon as possible.
Please, Excellency, allow me to reiterate my expectations as stated above, which you may wish to share with all relevant parties. I would also like to assure you and, through you, the Japanese Government that my Office is at your disposal to provide any assistance that may be required to facilitate the process of ratification of the Convention. I look forward to our continued partnership and would like to thank you for your support of our work.

本年7月4日から6日の私の日本公式訪問中、私は、
外務大臣政務官を含む日本政府の代表者の方々とお会いする機会を得ました。私は、特に国際組織犯罪に関連する国連薬物犯罪事務所（UNODC）の新たな任務について説明し、UNODCの活動を支援するとともに自らを組織犯罪と戦う国際的な努力の最前線に置こうとする日本の強いコミットメントを感受し得たことを喜ばしく思います。そのような文脈から、国際的な組織犯罪の防止に関する国際連合条約の締約国会議の来るべき会合につき、光栄にも閣下のご関心を賜る次第です。
締約国会議は、本条約が2003年に発効して以来これまで2回参集しており、2006年10月9日から18日にかけてウィーンにおいて第3回会合が開催されます。閣下、もし日本がこの会議に締約国の資格で参加することができないのであれば残念に思うという私の強い気持ちを共有させて頂きたいと思います。締約国会議の完全な一員となれば、日本は、法の支配の下で組織犯罪と闘い、より安全な世界を実現しようとする国際社会の努力をリードするグローバルな大国の一つとして、その役割を果たす最良の立場に立つでありましょう。
ご存じのように、本条約はその議定書とともに、組織犯罪に対する国際的な協力及び人身取引といった凶悪な犯罪との闘いのための現存する唯一の普遍的な法的枠組みです。本条約を未だ批准していない最後の政治経済大国の一つである日本が、可能な限り早期に本条約及びその議定書の締約国となり、これらの条約を完全に履行することは、日本のみならず国際社会全体にとって極めて重要であると信じます。
閣下、上記に述べた私の期待を繰り返させていただきたく、要すれば、これをすべての関係する方々と共有下さい。また、私の事務所は、本条約の批准プロセスを促進するために必要とされ得るいかなる支援をも提供する用意があることを、貴大臣及び貴大臣を通じ日本政府に確約したいと思います。我々の協力関係の継続を期待し、当事務所の任務への貴大臣のご支援に感謝致します。
